1. Owner (s) authorizes “H&J Constrution LLC.” to contact their insurance company and make a claim on Owner’s behalf for property damages. Owner(s) agrees to provide H&J Constrution LLC. with all the required insurance information, including claim number and insurance loss data information.

2. Owner (s) agrees not to allow any other person or entity to perform any of the work included in this claim. All work will be performed by H&J Constrution LLC. and paid Replacement Cost Value (RPC) to do so.

3. If the insurance company approves repairs of the property, Owner agrees to employ H&J Constrution LLC. to perform all work approved by the insurance company for the amount paid by them or the amount agreed to by both Owner and H&J Constrution LLC.

4. The insurance company will determine and set the price of the claim. The owner(s) agree that H&J Constrution LLC. will do the work as specified on the insurance Scope of Loss Sheet.

5. Owner (s) agrees to assign right to payment to H&J Constrution LLC. and that the insurance checks will be payable to H&J Constrution LLC.

6. I understand that by signing this agreement I am bound by the terms of this agreement and testify that I am the Owner or acting on behalf of the owner, spouse, or landlord.

7. The Contractor will deposit the first insurance check prior to commencing work and will deposit the second insurance check after the work has been completed.

8. If the owner(s) cancels the agreement after the insurance approval, the owner agrees to pay H&J Constrution LLC. as compensation for their service and not as a penalty as follows: 20%.

NOTE: It is unlawful for an uninsured to profit from an insurance claim.
NOTE: H&J Constrution LLC. is only approved to make a claim on the Owner’s behalf and will not engage in negotiations of any kind with the insurance company as prohibited by Texas Law.
